That symbol pre-dates the Amazing Blue Oyster Cult by at least a gaggle of milleniums, being the mark of Kronos, the god of chaos and Saturn. So, I would venture to guess it's public domain by now.
If that excuse doesn't fly, how about this one- that avatar was applied unbeknownst to me by a Doofoid Zoomie, so it is he that should go to infringement prison.
